Here is a little bit of information on each of the ways someone can be released once they have been arrested.
Surety Bond - Bail Bond
A surety bond involves a contract with a bondsman (also know as a bond agent or bail agent) for the bail amount. The bondsman will then post a bail bond with the jail to assure that the accused will appear in court.Â The bail agent guarantees to the court that they will pay the bond forfeiture if a defendant fails to appear for their scheduled court appearances. The bail agentâ€™s guarantee is made through a surety company and/or by pledging property owned by the bail agent.
For this service, the defendant is charged a premium (typically 10% of the bail amount in California). For example, if the bail amount in $10,000.00, the premium charged is $1,000.00. Prior to the posting of the surety bond, the defendant, friend or relative must contact a licensed bail agent. Once a bail agent is contacted, an interview or appointment will be immediately scheduled.
Cite and Release
A Citation Release involves the issuance of a citation to the arrestee, informing the arrestee that he or she must appear for an appointed court date. This is typical for more minor infractions such as traffic violations.
Own Recognizance (OR)
Defendants can be released on their Own Recognizance, also known as â€œORâ€. This is usually reserved for lesser crimes. Release on your 'own recognizance' gets you out of jail without bail money or bond. You're on your honor to return for the court proceedings. If you fail to return for trial, a bench warrant is issued; but you suffer no financial hardship. In order to determine your eligibility for an 'own recognizance' release, a court administrator or judge will interview you while you're in custody. Many times this interview is even conducted over the phone. The interview provides the information an official needs to make a recommendation to the court.Â If you're unable to make bail, this release can allow you to return to employment and regular living while awaiting trial.
To be released on cash bail, an individual must post the full amount of the the bail with the court in the form of cash or cashiers check. In order to post cash bail, an individual should check with the clerk to verify forms of payment accepted in an individual jurisdication as different courts may have other options or restrictions. The source of funds for large bail generally must be verified to ensure that funds come from legal sources.
After the case has been resolved, the entire amount is refunded. Cash bail is a good option for people with a low dollar bail amount or who can afford to have large sums of money tied up for an extensive period of time.
A defendant occasionally may obtain release from custody by means of posting a property bond. In this procedure the court records a lien on property owned by the defendant to secure the amount of bail. If the defendant fails to appear at a scheduled court date, the court may institute foreclosure proceedings against that property to obtain the bail amount. This is usually an involved process including title reports and appraisals on the property. Often times it may take several weeks to obtain a Property Bond.
